This notice applies to Toka Tū Ake EQC and the Holidays Act Remediation Form.

Toka Tū Ake EQC is committed to being a trusted kaitiaki (guardian) of the personal information we collect.

Toka Tū Ake EQC will collect and use your information provided via this webform to verify your application for payment relating to Holidays Act Remediation, to ensure the information we hold is accurate and update before making we make a payment, and in accordance with the Privacy Act 2020 and the Holidays Act 2003.

If you do not provide us with the information requested this will affect our ability to make remediation payments that may be due to you.

Who should use this form?

This form is for former Toka Tū Ake EQC employees who have been contacted in relation to the Holidays Act 2003 and are due a repayment.

Identification information
Identification information is required to confirm payment is processed to the correct person, this includes:

  • Name
  • Date of birth
  • Identification documentation (in the form of a photograph or scan)

If you are completing the form on someone else’s behalf additional documentation will be used to verify your authority to act on their behalf, including:

  • Deceased estate, authority to act, or similar documentation

Financial information

Financial information is collected to enable payment, including your:

  • Bank account evidence (in the form of a screen shot, photograph or scan)

To ensure taxable deductions and KiwiSaver are applied correctly the following is collected:

  • Tax details
  • KiwiSaver information

If your financial details have not changed since your employment by Toka Tū Ake EQC, you will not need to supply them again.

How we may disclose your personal information

We only disclose your information) in connection with our lawful functions and in accordance with relevant legislation, including the Holidays Act, and the Privacy Act.

If you would like access to, or correction of, your personal information please contact us via holidaysact@eqc.govt.nz. We may require proof of your identity before we provide you with a copy of this information.
